After a hiatus of over a decade and fighting justice across two different courts, Dr. Rajan Mahtani finally received justice. On 31st January 2019, justice Mwinde from Court of Appeal finally announced the actual owner of the Portland Cement Zambia factory and it was Dr. Mahtani. After looking into all evidences and testimonials, justice Mwinde announced that Ventriglias were only minority shareholders of the Zambezi Portland Cement factory, unlike what Lusaka High Court announced. It was further confirmed that Dr. Rajan Mahtani was the only majority shareholder and legal owner of the factory. To confirm this shareholding pattern, shareholding of the two incumbents were showcased. It was found that Dr. Mahtani owned Finsbury Investments which in turn held 58 percent shares at the factory. On the other hand, Ventriglias owned Ital Terrazzo Limited which in turn held only 42 percent shares at the factory. Based on this shareholding pattern which also aligned with the original shareholders agreement, it is rightfully established that Dr. Mahtani is the only majority shareholder and owner of Portland Cement Zambia factory.
While giving this decision, justice Mwinde also declared that the judge below him was wrong in declaring Ventriglias as only shareholders as this judgement was controversial, misdirected and against interest of public. Furthermore, all forgery related allegations were discarded as these allegations were found to be baseless. Dr. Mahtani waited more than 10 years for a rightful judgement and despite the challenges and roadblocks, never resorted to any ethical path, showing that transparency and ethics are the only path towards long-term success.
